Dear Longy Board of Trustees Member,
The expertise, good will, and dedication the faculty has contributed to the Longy School of Music over many years, has helped to create the unique institution that the community has come to know. This past March the Longy School of Music administration announced a major reorganization in which they unilaterally reassigned faculty, removed students from their teachers, and terminated many long-term, highly esteemed faculty. The School's administration has steadfastly refused to negotiate over these changes before implementing them, though they are required by law to do so. Good faith bargaining is key to preserving the wonderful qualities of Longy, anticipating future directions, respecting its faculty, and affirming the value of musicians to our students.
The American Federation of Teachers Massachusetts has filed charges against the Longy School of Music for unfair labor practices within the meaning of section 8(a), subsections (1) and (5) of the National Labor Relations Act. The administration has repeatedly refused to bargain over the drastic changes to terms and conditions of employment that it announced in letters that were mailed to the faculty dated March 12, 2010. These changes were made suddenly and unilaterally, without advance warning to affected faculty and with no opportunity for affected faculty to defend themselves. The Negotiating Committee of the Longy Faculty Union (LFU) has repeatedly asked the administration, both verbally and in writing, to rescind the changes and negotiate them, but administration has declined, claiming that the changes were within the scope of their legal management rights.
The Negotiating Committee has sought and gathered information about these changes while simultaneously researching and writing a new proposed contract. As of August 3, 2010, the Committee has submitted over forty articles of a detailed proposed contract to the administration. As was noted in the last issue of the LFU newsletter (July 28, 2010 -- vol. 1, no. 8; see http://jonathancohler.com/longyfacultyunion/Newsletter/), the Negotiating Committee has been submitting proposals on a week-by-week basis since mid-May; to date, it has received responses to only two proposed articles. Those responses, given to us in recent negotiating sessions, total less than one typewritten page of text.
Once again, we strongly urge the Longy administration to rescind its unilateral actions and begin to negotiate with our duly formed Union in good faith, as is required by Federal law. Rest assured that we are committed to protecting the rights and welfare of Longy faculty, its students, and the larger community. With the Bard merger on the horizon, this is a particularly exciting and pivotal moment in time. We ask that the Board of Trustees recognize our common interests, communicate them to the administrators, and fully appreciate our strong desire to reach a successful conclusion for all parties. Let us travel together down the path of mutual respect, shared goals, collaboration, and cooperation.
